7. Graphic Design and Creative Services
When you purchase graphic design or other creative services from The H Network, the specific scope of work may be described in a proposal, invoice, email, service listing, product page, or other written communication. Those project-specific details are incorporated into these Terms.
Project timelines may depend on your timely communication, approvals, materials, and feedback.
8. Client Responsibilities
For creative and design services, you agree to:
Provide accurate project information
Supply any required content, files, references, or instructions
Review drafts and deliverables in a timely manner
Respond to requests for approval, clarification, or revision within a reasonable time
Ensure that any materials you provide do not infringe the rights of others
You are responsible for obtaining any necessary rights, permissions, and licenses for content you submit to us.
9. Approvals, Non-Response, and Project Status
To keep projects moving, you agree to respond to drafts, proofs, revision requests, approval requests, and other project-related communications within 48 hours, unless a different time period is agreed to in writing.
If you do not respond within that time, The H Network may, at its discretion:
Treat the current stage as approved
Continue work based on the latest approved direction
Place the project on hold
Mark the project as inactive
Close the project as completed for the current contracted scope
If a project is delayed, paused, reactivated, or reopened due to client non-response, additional fees, revised timelines, and updated deliverables may apply.
10. Revisions
Unless otherwise stated in writing, revisions are limited to the number, scope, and timing described in the applicable proposal, invoice, service listing, or project agreement.
Requests outside the agreed scope may be treated as additional work and billed separately.
11. Delivery and Acceptance
Work may be delivered by email, download link, website account, cloud storage link, third-party platform, or another reasonable delivery method.
Unless otherwise stated in writing, final deliverables will be considered accepted when:
You expressly approve them
You use them publicly or commercially
You fail to raise a specific written issue within the stated response period
12. Refunds and Cancellations
All custom graphic design and creative services are non-refundable once work has begun.
If a project is canceled after work has started, you remain responsible for payment for work already completed, time already spent, reserved production time, and any non-refundable third-party costs.
Any refund, credit, or exception we choose to provide in one situation does not obligate us to do so in any future situation.
13. Intellectual Property
All website content, branding, graphics, text, logos, designs, game content, software, game assets, and other materials owned by The H Network are protected by applicable intellectual property laws.
Except as expressly stated in writing, no ownership rights are transferred to you through your use of our website or services.
Client Projects
For paid custom work, ownership or usage rights transfer only as stated in the applicable project agreement, invoice, product description, or written confirmation, and only after full payment has been received.
Unless otherwise agreed in writing:
The H Network retains all preliminary concepts, drafts, unused designs, working files, and production methods
You receive rights only to the final approved deliverables specifically provided to you after full payment
The H Network may display, publish, and use completed client work in portfolios, advertisements, promotional materials, social media, case studies, and marketing materials
If a client requires confidentiality for finished work, that confidentiality must be set out in a separate written agreement accepted by both the client and The H Network before the confidential restriction applies
14. Promotional Use of Finished Client Work
By purchasing graphic design or creative services from The H Network, you grant The H Network the right to display and use the finished work for portfolio use, advertising, promotional display, marketing, social media, and related business purposes.
If a client requires the finished work to remain confidential, that restriction must be included in a separate written agreement signed or otherwise accepted in writing by both parties before The H Network is bound by that confidentiality restriction.
15. Video Games and Game Assets
All video games, downloadable content, patches, updates, art, designs, code, music, visual elements, characters, files, and related game assets made available by The H Network remain the sole property of The H Network unless expressly stated otherwise in writing.
When you purchase or access a game from The H Network, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use that game for personal, lawful use only.
You do not receive ownership of the game or any game assets by purchasing or accessing the game.
Unless expressly permitted in writing, you may not:
Copy, extract, reuse, distribute, sell, sublicense, modify, or republish game assets
Use game assets for your own projects, products, branding, games, or commercial purposes
Publicly share, post, upload, or distribute game assets outside normal gameplay, authorized promotional use, or other permitted use
Reverse engineer, decompile, or attempt to separate protected game files or assets except where non-waivable law expressly permits it
Unauthorized use, reproduction, extraction, modification, or public sharing of game assets is prohibited and may constitute copyright infringement or other violations of law.
16. User Content
If you upload, submit, send, or share content with us, including files, text, images, artwork, or messages, you grant us a limited, non-exclusive license to use that content as reasonably necessary to provide services, process orders, operate accounts, communicate with you, and maintain our business operations.
You represent that you have the necessary rights to submit that content and that it does not violate any law or third-party rights.
We may refuse, remove, or disable content that we believe is unlawful, infringing, abusive, harmful, or otherwise inappropriate.
17. Third-Party Services and Links
Our website or services may link to or integrate with third-party services and platforms, including Square, PayPal, Steam, Google Analytics, Discord, Facebook, and Instagram. We are not responsible for the availability, content, conduct, or policies of those third parties.
